Welcome to the Hillcrest Ranch Homeowners' Association CC&R' Violation Schedule Of Fines. This Schedule Of Fines was written to help our Association Members to avoid confusion over the assessment of fines for violation of the CC & R's of the HOA Association.

The Schedule Of Fines was developed because there was confusion being expressed among the Association Members, at HOA meetings in late 2002, as to what the fines for the various violations were.

The Schedule Of Fines was developed and discussed in the open meeting of September 2002 by all of the Association Members present and the Board Of Directors. No vote was taken so that the Association Members could have time to give input to the Board Of Directors as to the fairness of the Schedule Of Fines.

The Schedule Of Fines was again discussed in open meeting by the Association Members present and the Board Of Directors at the October 2002 Meeting. Changes were made to the original suggestions by the Association Members present at the meeting and Board Of Directors. The Board Of Directors then voted to approve the Schedure Of Fines for CC & R Violations which is presented here.

A copy of the Schedule Of Fines was then sent out to all Association Members in their March 2003 Billing. The Management Company was instructed not to use this Schedule Of Fines until after the March 2003 billing had been sent to all Association Members.

HILLCREST RANCH HOMEOWNER ASSOCIATION CC&R VIOLATION, FINE SCHEDULE

1. Property Alterations And Improvements Made Without Architectural Committee Approval $100 Each Occurrence. Since Homeowners Are Responsible To Know And Understand The CC&Rs No Warning Letter.

2. Commercial Vehicle Violations. Vehicle ¾ Ton Or More In Weight Violations. Recreation Vehicle Violations. Includes Boats, All Types Of Trailers, Motor Homes, etc. Checked for compliance every 48 hours from date and time of first notice of the violation by inspector.

A. First Notice Within Twelve Consecutive Months - Warning Letter

B. All Other Notices Within Twelve Consecutive Months Fined At $100 Each Notice. If In Violation, Inspection Notice And Fine Every 48 Hours Until Violation Corrected.

3. Unauthorized Garage Sale. Checked for compliance every 24 hours from date and time of first notice of the violation by inspector.

A. First Notice Within Twelve Consecutive Months - Warning Letter

B. All Other Notices Within Twelve Consecutive Months Fined At $50 Each Notice. If In Violation, Inspection Notice And Fine Every 24 Hours Until Violation Corrected.

4. Loose Trash Placed On Any Area Of The Homeowners Property, Or Other Property Within The Hillcrest Ranch HOA, Visible From The Street, For The Monthly Loose Trash Pick Up By The City Of Glendale Earlier Than Five Days Of The Scheduled Day Of The Monthly Loose Trash Pick Up By The City Of Glendale, Sanitation Division.

A. First Notice Of Violation Within Twelve Consecutive Months - Warning Letter.

B. All Other Notices Within Twelve Consecutive Months Fined At $50 Each Notice. If In Violation, Inspection Notice And Fine Every 24 Hours Until Violation Corrected.

5. Loose Trash Not Cleaned Up From Any Area Of The Homeowners Property, Or Other Property Affected By The Homeowners Loose Trash Within The Hillcrest Ranch HOA, Visible From The Street, After The Actual Monthly Loose Trash Pick Up Day. First Inspection Not To Be Conducted Until At Least 24 Hours After Midnight Of The Actual Day Of The Monthly Trash Pick Up.

A. First Notice Of Violation Within Twelve Consecutive Months - Warning Letter.

B. All Other Notices Within Twelve Consecutive Months Fined At $50 Each Notice. If In Violation, Inspection Notice And Fine Every 24 Hours Until Violation Corrected.

6. Trash Containers Visible From Street After Collection By The City Of Glendale, Sanitation Division.

A. First Notice Of Violation Within Twelve Consecutive Months - Warning Letter.

B. All Other Notices Within Twelve Consecutive Months Fined At $25 Each Notice. If In Violation, Inspection Notice And Fine Every 24 Hours Until Violation Corrected.

7. Parking On Unauthorized Part Of Yard Area. (Other Than Driveway)

A. First Notice Of Violation Within Twelve Consecutive Months - Warning Letter.

B. All Other Notices Within Twelve Consecutive Months Fined At $25 Each Notice. If In Violation, Inspection Notice And Fine Every 24 Hours Until Violation Corrected.

8. Unauthorized Signs Placed On Homeowners Property Or On Common Area Property Within The Hillcrest Ranch HOA. (Including Garage Sale Signs).

A. First Notice Of Violation Within Twelve Consecutive Months - Warning Letter.

B. All Other Notices Within Twelve Consecutive Months Fined At $25 Each Notice. If In Violation, Inspection Notice And Fine Every 24 Hours Until Violation Corrected.

9. Disabled Vehicles Left On Street.

A. First Notice Of Violation Within Twelve Consecutive Months - Warning Letter.

B. All Other Notices Within Twelve Consecutive Months Fined At $25 Each Notice. If In Violation, Inspection Notice And Fine Every 24 Hours Until Violation Corrected.

12. Backwashing Pools Into Common Areas.

A. First Notice Within Twelve Consecutive Months - Warning Letter

B. All Other Notices Within Twelve Consecutive Months Fined At $100 Each Notice. If In Violation, Inspection Notice And Fine Every 24 Hours Until Violation Corrected.

13. Repair And Upkeep Of Property.

A. First Notice Within Twelve Consecutive Months - Warning Letter

B. All Other Notices Within Twelve Consecutive Months Fined At $25 Each Notice. If In Violation, Inspection Notice And Fine Every Two Weeks Until Violation Corrected.

14. All Other Violations.

A. First Notice Within Twelve Consecutive Months - Warning Letter

B. All Other Notices Within Twelve Consecutive Months Fined At $25 Each Notice. If In Violation, Inspection Notice And Fine Every Two Weeks Until Violation Corrected.

Note* All first warning letters must describe the CC&R being violated and the fine schedule that will be applied for non-compliance including the amount of time the homeowner has to comply, the frequency of inspection and the amount of money to be levied in the fine if the violation is not brought into compliance.
